Terms of Service

PassTheBib ("PassTheBib," "we," "us," or "our") is based in Zürich, Switzerland. These Terms of Service ("Terms") govern your access to and use of the passthebib.com website and any related services (together, the "Service"). You can reach us at support@passthebib.com for any legal notice or question about who operates the Service.

By creating an account, listing a race entry, or purchasing a listing on PassTheBib, you agree to these Terms, our Privacy Policy, and our Bib Transfer Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that all information you provide to us is accurate.

PassTheBib provides a marketplace where runners can list a race entry for transfer and other runners can find and pay for one, plus a payment-escrow service so money only moves once a transfer is confirmed.

PassTheBib is not the race organizer and is not a party to your race registration, entry agreement, or any waiver you sign with the organizer. We do not process, transmit, or submit the actual registration transfer to any race organizer. That transfer is completed directly between the buyer and seller, through the organizer's own official process, entirely outside of PassTheBib. See our Bib Transfer Policy for details.

We do not guarantee that any race organizer will approve or process a transfer, that a race will take place as scheduled, or that a listing is accurate. We are not a sports federation, travel agency, ticketing company, or insurer.

We only permit listings for races that have a confirmed, official organizer policy allowing entry transfers. We may remove or reject a listing at any time, including if we learn a race does not actually support transfers, or if a listing looks inaccurate, fraudulent, or otherwise violates these Terms.

As a seller, you represent and warrant that:

• You are the person currently and validly registered for the race entry you are listing, or you are otherwise legally entitled to transfer it;
• The entry has not already been sold, transferred, or listed elsewhere;
• All information in your listing (race, date, city, price, and entry details) is accurate and current; and
• You will personally complete the race organizer's official transfer process with the buyer.

Listing a race entry is free. Buyers pay a PassTheBib service fee on top of the seller's asking price; the exact amount is always shown and confirmed before you pay — never added afterward. If the race organizer charges its own official transfer fee, that is separate from PassTheBib, is shown on the listing where known, and is paid directly to the organizer, not to us. We are not responsible for organizer fees or for changes an organizer makes to them.

All payments are processed by Stripe, a third-party payment processor. PassTheBib does not receive or store your full card or bank details.

When a buyer pays for a listing, funds are held in escrow by Stripe and are not released to the seller immediately. Funds are released to the seller only when:

• the buyer confirms, through the Service, that the organizer's official transfer was completed; or
• a reasonable confirmation window has passed after the seller indicates the transfer was completed and the buyer has not responded, in which case funds may be released to the seller automatically; or
• the parties otherwise agree, or PassTheBib determines a release or refund is appropriate after reviewing a dispute.

If a transfer does not happen, the buyer's payment is refunded, less any amount already paid to a third party (such as an organizer's non-refundable transfer fee) where applicable. PassTheBib is not a bank and does not pay interest on funds held in escrow.

Whether you are buying or selling, you agree that you will:

• comply with the race organizer's rules, eligibility requirements, and official transfer process in full;
• provide the organizer with accurate identity, contact, and medical/emergency information as the new entrant, if you are the buyer;
• not attempt to pay or be paid outside of the Service's escrow flow for a listing made on PassTheBib;
• not list or attempt to buy an entry for a race that does not have an official transfer policy; and
• not use the Service for any fraudulent, deceptive, or unlawful purpose.

In addition to the above, you may not:

• impersonate another person or misrepresent your identity or affiliation;
• list an entry you are not entitled to transfer, or list the same entry more than once at a time;
• circumvent, disable, or interfere with the escrow or confirmation process;
• use the Service to violate a race organizer's rules, including transferring an entry to or from a race that prohibits it; or
• scrape, reverse-engineer, or misuse the Service outside of normal use.

We may suspend or terminate accounts, remove listings, and withhold or reverse payments in connection with a violation of this section.

Participating in a race — running, walking, cycling, or otherwise — carries inherent risks, including risk of injury or death. Those risks exist independently of PassTheBib and are not created or increased by our Service. If you buy a transferred entry, you alone are responsible for confirming your own fitness and eligibility to participate, and for making sure the organizer has your correct emergency and medical information as the new entrant.

PassTheBib has no role in, and no liability for, the conduct of any race, any injury or harm occurring during or in connection with participation in a race, or any decision made by a race organizer, including disqualification, refusal of a transfer, or cancellation of an event.

The Service, including its design, text, graphics, and underlying software, is owned by PassTheBib or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service except as needed for your own personal, non-commercial use of it.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that listings are accurate or complete, or that any race organizer will honor a transfer.

To the fullest extent permitted by applicable law, PassTheBib and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or a race entry, arising out of or related to your use of the Service — including any loss connected to a race organizer's decision, an event cancellation, or your participation in a race.

To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service will not exceed the greater of (a) the fees you paid to PassTheBib in the 12 months before the event giving rise to the claim, or (b) CHF 100 (or the equivalent amount in your local currency).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our gross negligence or willful misconduct, or any statutory consumer protection rights you may have that cannot be waived.

You agree to indemnify and hold harmless PassTheBib and its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of: your use of the Service; your listing, purchase, or transfer of a race entry; your violation of these Terms, the Bib Transfer Policy, or any race organizer's rules; or your participation in a race using a transferred entry.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or created risk or legal exposure for PassTheBib or another user. You may stop using the Service and delete your account at any time by contacting us.

We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above and, where appropriate, notify you. Continuing to use the Service after a change takes effect means you accept the updated Terms.

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. Subject to the paragraph below, any dispute arising out of or relating to these Terms or the Service will be brought exclusively before the competent courts of Zürich, Switzerland.

If you are a consumer, nothing in this section deprives you of the protection of any mandatory provisions of the law of the country in which you are resident, including your right to bring proceedings before the courts of that country. Before starting a formal dispute, please contact us at support@passthebib.com — most issues can be resolved directly.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and Bib Transfer Policy, are the entire agreement between you and PassTheBib regarding the Service.
